The attached
note provides you with information on an urgent problem with
the Fisheries Act 1996 identified in a recent review of a Ministerial
decision on catch limits by the High Court.
In response to advice on the legal implications of the Court findings,
the Minister of Fisheries, with Cabinet endorsement, has asked that
advice on options for amendment of the Act be prepared urgently.
The objective of the government is to restore the ability of the
Minister to lawfully set total allowable catches (TACs) for stocks
where quantitative estimates are not available of current stock
levels in relation to the level that is able to produce the maximum
sustainable yield.
As this matter deals with a fundamental aspect of the management
system, the Ministry would like to ensure that all stakeholder groups
are informed of the issue and are kept up to date with the process
for dealing with it.
Officials are calling an urgent meeting at MFish in Wellington on
Thursday 10 April (3.00-5.00pm) to discuss the effect of the judgement,
necessity for urgent amendment and the potential form of an amendment
to s13 of the Fisheries Act.
A representative of your organisation is welcome to attend that
meeting. If you wish to attend please respond by return e-mail to

We will endeavour to also provide your organisation with regular
advice as to progress with the amendment over the coming weeks.
